Our debt collection agency can never predict how long it will take to recover your money. The debt may be recovered following my letter of demand or it takes a procedure in court to make the debtor pay. Often debtors end up on a payment programme but even these can stop and start several times before the debt is fully recovered.

You must send in your debts for collection as soon as you sense the slightest problem. If the debtor does not pay after our involvement in the extrajudicial phase then we may recommend that legal action is instigated against him/her through the Courts. While we are successful in making numerous recoveries without the necessity of a lawsuit, some debts require formal legal action. Before suit is filed, you will receive a written report explaining the results of our initial investigation and our efforts to contact the debtor, the terms of any settlement proposal made by the debtor, and our recommendations. The costs and fees required to initiate a lawsuit will be submitted to you for your review and approval before proceeding with suit. No costs or fees will be incurred without your prior approval.. At that time, you will make the decision of whether you want to proceed with suit.

Based on the information provided, a payment plan which is both acceptable to our client, and affordable to you, will be established.

If you do not agree with the amount that is shown on the summons, you must contact us straight away. Send us a letter explaining why you do not owe the debt. Whatever the reason, we will listen to you, and advise you on the next course of action that you must take. Once you have done this, we contact you to tell you we stop all collection activity or that we are going to sue you.

You have been summoned to appear before the court to provide a reason for non payment. It is your right to answer the summons and attend the court. We therefore recommend that you contact the debt recovery team to discuss your case as quickly as possible.

You have received a summons because you have not paid the amounts that were due according to your installment scheme or the subsequent reminders. Regrettably this is the next course of action that must be taken to enforce the debt. However we are keen to discuss with you the reasons why you have not paid and consider the options available to you in settling the balance outstanding.

The court will apply for a liability order and for costs to be added to your debt. The liability order will empower us to collect the debt by a number of different options.

After we have a Court Judgment we can contact your employer to garnish your wages. This will happen by sending your employer an official document from the Bailiff Services ordering him to do so.

With a court order we can legally seize/freeze funds in your bank account. With a judgment against you we can go to someone who is holding money for you (bank, credit union, trust company) and intercept that money through a garnishment of your bank account.

Yes, your debt has now been passed to the bailiffs to be collected. All further payments should be made directly to the bailiffs. Failure to do so may lead to the bailiffs being unaware that you have made a payment and may lead to additional costs being added to your debt.
